Use

There are two aspects to consider.

First is the use which is permitted by the terms of the lease which may be narrow or broad depending on the wording used.

The other is the use which is authorised under planning law which the landlord will not accept any responsibility for but which the tenant will be required to observe.

They are not always the same and a Landlord will normally seek to avoid liability for any discrepancy.

Conflict between these two permitted uses can result in significant difficulty and possible financial loss. Rent reviews may be affected by the use provision in the Lease. On the other hand the more restrictive the use permitted by the lease the more difficult it may be to dispose of the lease.
